  1. Acceptance of the Privacy Policy

    BookJane Inc. (“BookJane”, “we”, “us”, “our” and terms of similar meaning) take your privacy rights very seriously. We are committed to transparently describing our privacy practices, including how we collect, use and disclose your information and data as part of providing the Service, as defined in our BookJane Jane Terms and Conditions (“Jane Terms”) and our BookJane Client Terms and Conditions (“Client Terms”, collectively with the Jane Terms, shall hereinafter be referred to as the “Terms”).

    We encourage you to read and understand our Terms and this Privacy Policy before using the Service. By accepting the Terms and/or Privacy Policy in registration for an Account, by accessing the Website or using the Service, you expressly consent to our collection, use and disclosure of your personal and/or business information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms.

    All capitalized terms that are not otherwise defined herein obtain their meaning from the Terms.

  2. What Information Do We Collect?

    Our primary purpose in collecting personal and/or business information from you is to provide you with a safe, smooth, efficient, and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. We only collect personal and/or business information about you that we consider necessary for achieving this purpose.

    Personal/Business and Identifying Information

    In general, you can browse the public facing sections of our Website and/or Applications without telling us who you are or revealing any personal or business information about yourself. However, in order to use the Service, you must register for an Account. When registering for an Account, you must provide various contact and identity information and other personal and/or business information as requested or where indicated on the Service. At this time, you are no longer anonymous to us. Where possible, on these forms we indicate which fields are required and which fields are optional. In addition, as you use the Service, you can from time to time enter or send to us personal and/or business information. This may include information that you share through the Service with us and/or other users.

    If you are able to and do sign up for an Account using a Third-Party Provider Account, we will also get basic information from your Third-Party Provider Account profile, which may include your name, gender, profile photo and connections.

    You represent that you have the right and authority or have obtained all necessary consents to provide any information, including any personal information of another individual or corporate information, that is provided by you to BookJane.

    You always have the option to not provide information by choosing not to become a user of the Service.

    Jane and Client Information

    For Janes, in order to use and while using the Service, you may be required to provide, among other information and documentation, your name, address, phone number, e-mail address, password, photo and other personal and identifying information (as set forth in the Terms and through the Service). As described in our Terms, you may also be required to submit additional Verifying Information, which may include, without limitation, your criminal record, current vulnerable sector police checks, up-to-date immunization records, criminal background check documentation, current registration with the applicable provincial licensing authority, diplomas and certificates, first aid and cardiopulmonary resuscitation (CPR) cards and food handling certificate. In addition, we may perform our own criminal background checks, other searches and verification checks.

    For Clients, in order to use and while using the Service, you may be required to provide, among other information and documentation, your business name, address, contact name, phone number and e-mail address, password, business logo, trademarks and other business and identifying information (as described in the Terms and through the Service). As described in out Terms, you may also be required to submit additional Verifying Information, which may include, without limitation, proof of having all appropriate, up-to-date, valid and required licenses, credentials, approvals and authorizations to operate a health care facility in Canada and in the province(s) in which the Client operates. In addition, we may perform our own searches and verification checks.

    Payment Method

    If you have registered for an Account, we may collect your credit card, other payment and/or banking information. When you add a credit card, payment method and/or banking information to your Account, such information may be shared with our third-party payment processor(s). We do not store credit card, other payment and/or banking information on our servers.

    Information Collected Automatically

    When you use the Service, BookJane automatically receives and records information from your device, including, without limitation, your location, IP address, browser type (if applicable), operating information, mobile carrier (if applicable), device and Application IDs, cookie information, and the page you requested. Unless otherwise stated in this Privacy Policy, BookJane only uses this data in aggregate form.

    "Cookies" are small files placed on your hard drive that assist us in providing the Service. We use cookies to allow you to enter your password less frequently during a session, and we use data collection devices, including cookies, on certain pages of the Service to help analyze usage and to offer certain features that are only available through the use of a cookie and to allow us to provide information that is targeted to your interest.

    The Service uses location services made available online and by iOS, Android and other platforms. Location services allows location-based applications and websites, like the Service, to use information from internet service providers, cellular, Wi-Fi, Global Positioning System (GPS) networks, and iBeacons to determine your approximate location. We use location services to facilitate the ordinary operation of the Service, including tracking the location of users and displaying that information to other users in order to facilitate a booking through the Service.

    User Feedback

    We may collect ratings and review information from Janes and Clients. Such ratings and reviews are made in accordance with the Terms.

  3. How We Use Your Information

    We may use personal and/or business information in the file we maintain about you, and other information we obtain from your current and past activities on the Service, to provide to you the Service; communicate with you, either directly or through one of our partners, including for marketing and promotional purposes; to advise of pricing and service updates; facilitate transactions and payments; resolve service disputes; troubleshoot problems; inform you about online and offline offers, products, services, events and updates; deliver information to you that, in some cases, is relevant to your interests; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our Terms; provide you with system or administrative messages; and as otherwise described to you at the time of collection or use.

    We may also use personal and/or business information about you to improve our marketing and promotional efforts, to analyze usage of our Service, to improve our content and product offerings, and to customize the Service’s content, layout, and services. These uses improve the Service and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe and customized experience while using the Service.

    Finally, we may use your personal and/or business information and/or Verifying Information to determine your eligibility to be listed as a Jane or a Client on the Service and, if and once approved as a Jane or Client, we may display such information and documentation on the Service for other users to see and/or send it to another Client or Jane upon their request.

    We keep your personal and/or business information for as long as it is required for the purposes for which it was collected, which is determined in our sole discretion, in accordance with the applicable laws. Please see our Terms for more information on what we do with your User Content when your account is terminated with us.

  4. Our Disclosure of Your Information

    We will share your personal and/or business information with third parties only in the ways that are described in this Privacy Policy, the Terms and in accordance with your consent. We will not sell or rent your personally or business identifiable information to third parties without your explicit consent. The following describes some of the ways that your information may be disclosed in the normal scope of business to provide our services:

    Sharing Between Users. Clients and Janes that have been connected for a booking will be able to see basic information about each other, including, as applicable, names, photos, ratings, Verifying Information and any other information added to a user profile or to a Posting. Clients and Janes may also be able to share information with each other through Communication Channels available through the Service (as further outlined in the Terms).

    Anonymized Aggregated Data. We aggregate and anonymize data and use and disclose such information for a variety of purposes, including analytics. However, in these situations, we do not disclose any information that could be used to identify you personally.

    Public Areas of the Service. All user activities in the public areas of the Service will be identifiable to your Account (username), and all users can see your published content.

    Law and Harm; Jurisdictions. Notwithstanding anything to the contrary in this policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect our or any other person’s rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

    Sale of Business. We may also disclose personal and/or business information to the acquiror or its agents in the course of the sale of our business. If we do this, the disclosure will be subject to confidentiality arrangements customary in such transactions.

    Storing or Processing Your Data Outside of Canada. Please note that in some cases, personal and/or business information that we collect may be stored or processed outside of Canada. In such cases, we continue to protect the information with appropriate safeguards, but it may be subject to the legal jurisdiction of those countries and governmental authorities in those countries.

    Subsidiaries and Affiliates; Service Providers. We may from time to time use the services of affiliates, subsidiaries and unrelated service providers in the operation of the Service, and may disclose personal and/or business information to them in the course of our use of their services. For example, we may use the services of third-party hosting companies to host the operation of the Service. This may involve the hosting of data, including personal and/or business information, on servers operated by those hosting companies. We take care to use only service providers that we believe are reputable and able to live up to our and your expectations, including about the handling of confidential information.

  5. Correcting and Updating Your Personal and/or Business Information

    You may review, delete and update your personal and/or business information to ensure it is accurate on the Service. Alternatively, you may contact us at [email protected] to update or delete your personal and/or information.

  6. Updating Your Communication Preferences

    You can always unsubscribe from our commercial and promotional emails, if any, but we will still send you communications relating to your Account and use of the Service.

  7. Children’s Privacy

    The Service is not intended for children under the age of eighteen (18). BookJane does not target its Service to children under eighteen (18). BookJane does not knowingly collect personal information from children under the age of eighteen (18).

  8. Security

    Your Account is protected by a password for your privacy and security. You must prevent unauthorized access to your account by selecting and protecting your password appropriately, and limiting access to your device.

    While we strive to protect your information and data, we cannot guarantee the security of your Account information. Unauthorized entry or use, hardware or Service failure and other factors, may compromise the security of user information at any time.

  9. Other Information Collectors

    Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties through the Service, different rules may apply to their use, collection and disclosure of the personal and/or business information you disclose to them. Since we do not control the information use, collection or disclosure policies of third parties, you are subject to their privacy policies. We encourage you to ask questions before you disclose your personal and/or business information to others.

  10. Changes to This Privacy Policy

    BookJane may amend this Privacy Policy from time to time. The use of information we collect is subject to the Privacy Policy and Terms in effect at the time the information is used. If we make any material changes in the way we use your personal and/or business information or data, we will notify you by (i) posting a notice on the Applications and/or Website; or (ii) sending you an email at the address registered on your Account or provided in your Registration Data. Users are bound by any changes to the Privacy Policy and Terms when they use the Service after such changes have been first posted.
